Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and StoneGroves ("we," "us" or "our"), concerning your access to and use of the stonegroves.sbs website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site") and our makeup and visagiste services ("Services").

You agree that by accessing the Site and/or Services, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and/or Services and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

We will alert you about any changes by updating the "Last updated" date of these Terms and Conditions, and you waive any right to receive specific notice of each such change.

It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Site after the date such revised Terms and Conditions are posted.

Services

StoneGroves provides professional makeup services for various occasions including but not limited to weddings, special events, photoshoots, and makeup lessons. The specific details, pricing, and terms of each service are outlined on our Services page or will be communicated to you directly during the booking process.

Service Availability

All services are subject to availability. We reserve the right to refuse service to anyone for any reason at any time.

Booking Appointments

When booking an appointment with StoneGroves, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your booking information and for all activities that occur under your booking.

Service Expectations

We strive to provide high-quality services that meet your expectations. However, makeup application is an art form, and results may vary based on individual skin types, conditions, preferences, and other factors. We will make every reasonable effort to achieve your desired look, but we cannot guarantee exact results.

Payments and Fees

Pricing

Prices for our services are as listed on our website or as quoted to you directly. All prices are in British Pounds (GBP) and include applicable taxes unless otherwise stated.

We reserve the right to change our prices at any time. Any price changes will not affect services that have already been booked and confirmed.

Deposits

For certain services, particularly weddings and large group bookings, a non-refundable deposit is required to secure your booking. The amount of the deposit will be communicated to you during the booking process.

Payment Methods

We accept various payment methods, including credit/debit cards, bank transfers, and cash payments. The available payment methods will be communicated to you during the booking process.

Final Payment

The balance of payment is due on or before the day of service, unless alternative arrangements have been agreed upon in writing.

Cancellation and Rescheduling Policy

We understand that circumstances may arise that require you to cancel or reschedule your appointment. Our cancellation policy is as follows:

Standard Appointments

  • Cancellations made 14+ days before the appointment: Full refund of any payments made (excluding non-refundable deposits).
  • Cancellations made 7-13 days before the appointment: 50% of the total service fee will be charged.
  • Cancellations made less than 7 days before the appointment: 100% of the total service fee will be charged.

Wedding Bookings

  • Cancellations made 60+ days before the wedding date: Loss of non-refundable deposit only.
  • Cancellations made 30-59 days before the wedding date: 50% of the total service fee will be charged.
  • Cancellations made less than 30 days before the wedding date: 100% of the total service fee will be charged.

Rescheduling

Requests to reschedule an appointment are subject to availability. We will make reasonable efforts to accommodate rescheduling requests, but cannot guarantee that a suitable alternative time will be available.

  • Rescheduling requests made 14+ days before the appointment: No fee, subject to availability.
  • Rescheduling requests made 7-13 days before the appointment: 25% rescheduling fee, subject to availability.
  • Rescheduling requests made less than 7 days before the appointment: 50% rescheduling fee, subject to availability.

Late Arrivals

If you arrive late for your appointment, your service time may be shortened to accommodate subsequent appointments. You will be charged the full service fee regardless of the shortened service time.

No-Shows

If you fail to attend your appointment without prior notice, you will be charged the full service fee, and future appointments may require pre-payment in full.

Health and Safety

Skin Conditions and Allergies

You must inform us of any skin conditions, allergies, or sensitivities prior to your appointment. We cannot be held responsible for allergic reactions or skin irritations resulting from failure to disclose this information.

Hygiene Standards

We maintain high standards of hygiene and sanitization in accordance with industry best practices. All tools and products are cleaned and sanitized between clients.

Illness

If you are unwell on the day of your appointment, particularly with any contagious condition, please contact us to reschedule. We reserve the right to refuse service to anyone who appears to be unwell to protect the health of our staff and other clients.

COVID-19 and Other Public Health Concerns

We adhere to all government guidelines and regulations regarding public health. Additional health and safety measures may be implemented during periods of public health concern, and compliance with these measures is mandatory for all clients.

Travel and On-Location Services

Travel Fees

For services provided outside our studio, travel fees may apply. Travel fees are based on distance from our studio location and will be communicated to you during the booking process.

Parking and Access

For on-location services, you are responsible for ensuring that adequate parking is available and that there is suitable access to the location. Any parking fees incurred will be added to the final invoice.

Working Environment

You must provide a suitable working environment for on-location services, including adequate lighting, seating, and space for our equipment. If the working environment is unsuitable and prevents us from providing our services effectively, we reserve the right to refuse service and the full service fee will still apply.

Intellectual Property Rights

Photography and Portfolio Use

We may, with your consent, take photographs of our work for use in our portfolio, social media, or other promotional materials. You may decline this use of your image, but this must be explicitly communicated to us prior to your appointment.

Website Content

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of StoneGroves or our content suppliers and is protected by copyright and other intellectual property laws.

Trademarks

The StoneGroves name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of StoneGroves or our affiliates. You may not use these trademarks without our prior written permission.

Limitation of Liability

To the fullest extent permitted by applicable law, StoneGroves shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  1. Your use of or inability to use our services;
  2. Any allergic reactions or skin irritations resulting from our services, provided that we have followed all reasonable industry standards and you have disclosed all relevant allergies and skin conditions;
  3. Any unauthorized access to or use of our servers and/or any personal information stored therein;
  4. Any interruption or cessation of transmission to or from our services;
  5. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party;

Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the amount paid by you to us during the six (6) month period preceding such claim.

Indemnification

You agree to defend, indemnify, and hold harmless StoneGroves, our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of:

  1. Your use of the services;
  2. Your breach of these Terms and Conditions;
  3. Any breach of your representations and warranties set forth in these Terms and Conditions;
  4. Your violation of the rights of a third party, including but not limited to intellectual property rights; or
  5. Any harmful act toward any other user of the services with whom you connected via the services.

Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

Governing Law

These Terms and Conditions and your use of the Site and Services are governed by and construed in accordance with the laws of the United Kingdom applicable to agreements made and to be entirely performed within the United Kingdom, without regard to its conflict of law principles.

Dispute Resolution

Any legal action or proceeding relating to your access to, or use of, the Site, Services, or these Terms and Conditions shall be instituted in the courts of the United Kingdom. You and StoneGroves agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.

Severability

If any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination

These Terms and Conditions shall remain in full force and effect while you use the Site or Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site and Services to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms and Conditions or of any applicable law or regulation.
